Village of Briarcliff Village Council Regular Meeting Minutes April 28, 2021

Mayor Hostetler called the meeting to order at 7:00 p.m.

Present: Aldermen Aldrich, Elliott, Hertel, Johnston and Richmond.

Citizens Communications:

Darrell Thornley, Lisa Putman, Ann Spry (Thurman Bend Road), Richard Downy, Jan McFarland and Cindy Taylor were all opposed to the bills for a Municipal Utility District on the “Holmes Ranch” and the development of 2,000 homes.

Representative Vicki Goodwin, announced that the bills are dead. Not pursuing the Municipal Utility District (MUD).

Alderman Richmond made a motion, seconded by Alderman Aldrich, to accept and waive the reading of the minutes of the March 31, 2021, Regular Monthly Meeting. All in favor, motion passed.

Alderman Hertel made a motion, seconded by Alderman Johnston, to accept and waive the reading of the minutes of the April 5, 2021, Special Called Meeting. All in favor, motion passed.

Alderman Richmond gave a brief review of the revenues and expenses of the March, 2021 financials.

All Council members agreed that the draft ordinance was correct. Mayor Hostetler stated the Parking Ordinance will be sent over to the Briarcliff Property Owners Association (BPOA) for them to review.

Mayor Hostetler gave an update about ongoing activities:

An update on the Holmes Ranch Development: First, we will not discuss this tonight since it is not on the agenda. I will pass on the latest things going on.

I announced at the January meeting that Aaron and I had met with Ned Holmes, CEO of Holmes Development and with a representative of Brown & Gay Engineers (BGE) about their effort to develop the Holmes Ranch. They stated in the meeting that it would be roughly 250 homes plus some higher density housing on the NE corner (their map showed a fairly small area). The topic of our consent being required for a Municipal Utility District (MUD) was discussed and they said they would provide us a draft agreement within a week. In the middle of March, we received an email that said they expect to have approximately 1650 homes plus the higher density housing so they are requesting approximately 2000 water taps. We told them that is not feasible and if they want to discuss further, they need to provide a fund of money that we can use to pay for engineering and legal fees. I reported this at our March meeting.

We heard nothing from them until this week. There has been legislation filed with the Senate and the House requesting that a MUD be established by the Legislature for the Holmes Ranch Development. I have called both Representative Goodwin’s and Senator Buckingham’s office and officially told them from the Mayor of Briarcliff that the Village does not consent to the formation of a MUD. And I asked them to withdraw the bills. The reason we’re just finding out about the bills is they were just filed April 22nd and April 26th.

Again, we cannot discuss this tonight since it is not on the agenda.

I received a call from Senator Buckingham’s Chief of Staff as I was driving to this meeting. After my phone call to her office the Senator has decided to pull her bill.

Daily activities for April, 2021 include the following:

Patrol every street for visibility purposes to deter crime, taking calls for service, self-initiating personal contact with the community to build a better partnership, stationary and rolling radar for compliance of the speed limit.

Monthly patrol hours: 168

Total of 49 calls for Service, 4 Traffic Stops, 1 Close Patrols, 14 Community Contacts.

City Manager, Aaron Johnson reported nothing new going on at the water plant however we have a lot of water taps to install and the wastewater is working fine. We have been busy. Lots are selling we only have 200 lots left to be built on in Briarcliff. We have a lot of capacity.
