TPIA Request — E-Bike Ordinance & March 2026 Meeting Records

On April 2, 2026, a Texas Public Information Act (Texas Government Code Chapter 552) request was submitted to the Village of Briarcliff seeking public records in six categories related to the March 25, 2026 Village Council meeting — including records concerning the proposed e-bike/e-motorcycle ordinance, request-to-speak forms, an “Exhibit A” referenced at the meeting, and Resolution 2026-03-25-06 (Annual Investment Policy).

The request included a fee waiver request under Texas Government Code § 552.267 and was submitted in electronic format.


The Village’s Response

April 17 — 10-day letter to the AG

On April 17, 2026, Village Attorney Erin A. Higginbotham of Bojorquez Law Firm filed a 10-day letter with the Office of the Attorney General under Texas Government Code § 552.301(b). The Village claimed three exceptions to disclosure — § 552.101 (confidential information), § 552.107 (certain legal matters / attorney-client privilege), and § 552.111 (agency memoranda / deliberative process) — and also asserted that some of the requested information “is not information that is collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business.”

The 10-day letter did not identify which categories or specific records are subject to any particular exception. All three exceptions were invoked broadly across the entire six-category request.

April 24 — 15-day brief and partial production

On April 24, 2026, the Village submitted its § 552.301(e) 15-day brief to the AG (OAG Tracking ID OR26019648). The requestor received a copy under § 552.301(e-1), along with 32 pages of records:

  • Category 1 — Request-to-Speak Forms: 22 completed forms from the March 25, 2026 meeting, all submitted for the e-bike agenda item. The Village redacted only the email address field on each form; names, home addresses, phone numbers, handwritten topic statements, and signatures were otherwise visible.
  • Category 6 — Resolution 2026-03-25-06: The adopted resolution and its attached Exhibit A (a 5-page Village of Briarcliff Investment Policy), signed by the Mayor and Village Clerk.
  • Categories 3 / 4 — Complaints & Pre-meeting Communications: One email thread (March 29 – April 1, 2026) between a resident, the BPOA office, and the City Secretary on the subject of e-bike enforcement on the dam and trail.

Records responsive to Category 2 (legal counsel consultation), the broader scope of Category 4 (pre-meeting communications), and Category 5 (“Exhibit A” distribution and omission records) were not included in this set. The Village’s substantive brief, linked above, sets out the exceptions the Village claims apply to the records being withheld.

Note

Additional redactions applied before publication. The Request-to-Speak forms as released by the Village expose speakers’ home addresses and personal phone numbers, and some of the speakers are minors. To avoid using this page to broadcast that contact information, the requestor has further redacted the PDF linked above: on each form, the three-row band covering the Address, Phone Number, and Email Address fields is blacked out — names, the meeting date, the residency checkbox, the handwritten topic statements, the acknowledgement, signatures, and the Village’s “Received by” line all remain visible. On the email thread pages, the resident’s personal phone number in his signature block has been redacted. On the final denial-email page, the third-party sender’s personal cell phone and personal email address have been redacted; his name, title, employer, work address, NMLS number, and the bank’s logo remain visible. No substantive content from the Village’s brief or the Category 6 public records has been altered.
